Important: These Terms govern your use of this website and related online interactions (inquiries, estimate requests, form submissions, SMS/email communication initiated through the site). Any landscaping services you hire us to perform are governed by a separate written estimate/contract that will include all California-required disclosures. If there is any conflict, your signed service agreement controls.
1) Acceptance of these Terms
By accessing or using this website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site. We may update these Terms at any time by posting a revised version with a new effective date. Your continued use of the site after changes are posted constitutes acceptance.
2) Eligibility; geographic focus
This site is intended for residents of the United States who are 18 or older. We primarily serve customers in Clovis, Fresno County, and nearby communities in California.
3) Relationship to project contracts (California home-improvement rules)
Website content is informational and for convenience only. Any landscaping, hardscaping, irrigation, or maintenance work will be documented in a separate written estimate/contract that complies with applicable California Home Improvement requirements (including down-payment limits, payment schedules, change orders, and mandatory notices). Deposits and progress payments, if any, will be stated in your written agreement and will comply with California law.
4) Estimates, scheduling, and changes
Estimates are based on the information you provide and site conditions visible at the time of consultation. If unforeseen conditions arise (e.g., hidden utilities or irrigation, soil or grading issues, code/permit requirements), we will discuss options and document any scope, price, or schedule changes in a written change order for your approval.
5) Online payments (if offered)
Online payments processed via third-party providers are subject to their terms and privacy policies. You agree not to make fraudulent or unauthorized payments and to resolve chargebacks in good faith.
6) Communications; electronic records; SMS
By submitting your information, you consent to receive electronic communications related to your inquiry (email, SMS, phone). SMS terms: message frequency varies; message and data rates may apply; reply STOP to opt out and HELPfor help; carriers are not liable for delayed or undelivered messages. We send service-related SMS (scheduling, appointment updates, customer support). We will not send promotional SMS unless we obtain your prior express written consent. Consent is not a condition of purchase.
7) Your responsibilities; acceptable use
You agree to: (a) provide accurate information; (b) use the site only for lawful purposes; (c) not interfere with or disrupt the site or its security; (d) not use automated means to access, scrape, or copy site content without our written permission; (e) not submit unlawful, infringing, or harmful content; and (f) not impersonate others or misrepresent your affiliation.
8) Content, accuracy, and no professional advice
We try to keep the site accurate and up to date, but content may be informational, generalized, or illustrative only. The site does not provide legal, engineering, or architectural advice. You should rely on the specific details in your written estimate/contract and applicable codes/permits. This page is general information, not legal advice.
9) Intellectual property; limited license
The site and its content (text, logos, photos, graphics, video, design) are owned by QLM or our licensors and protected by law. We grant you a limited, revocable, non-transferable license to view the site for your personal, non-commercial use. Except as permitted by law, you may not copy, modify, create derivative works from, distribute, publicly display, or otherwise use site content without our prior written consent.
10) User submissions and feedback
If you submit messages, reviews, photos, or other content, you grant QLM a non-exclusive, worldwide, royalty-free license to use, reproduce, host, and display such content to operate the site, respond to you, and—if you consent—for marketing/portfolio purposes. You represent that you have all rights necessary to grant this license and that your submissions do not infringe others’ rights or contain unlawful material.
11) Portfolio photos and testimonials
With your consent, we may photograph/record completed work for our portfolio, website, or social channels. If you prefer not to be featured, notify us in writing and we will honor your request.
12) Third-party services and links
The site may link to third-party websites or integrate third-party tools (e.g., maps, analytics, payment processors). Those services are governed by their own terms and privacy policies. We are not responsible for third-party content, products, or services.
13) Copyright concerns (no DMCA agent designated)
We respect intellectual property rights. If you believe content on our site infringes your rights, please send a notice including: (1) identification of the copyrighted work; (2) the specific URL or description of the material you want removed; (3) your name, mailing address, telephone number, and email; (4) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; (5) a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act; and (6) your physical or electronic signature.
We may remove or disable access to the material and, where appropriate, notify the user who posted it. We also reserve the right to terminate users who repeatedly infringe.
Note: We have not designated a DMCA agent with the U.S. Copyright Office. If we later designate an agent for DMCA safe-harbor purposes, we will update this section with the agent’s contact details and a link to the Copyright Office directory.
14) Disclaimer of warranties (website)
To the maximum extent permitted by law, the site and all content, features, and materials are provided “as is” and “as available.” We make no warranties of any kind, express or implied, regarding the site, including any implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, or non-infringement. We do not warrant that the site will be uninterrupted, timely, secure, or error-free.
15) Limitation of liability (website)
To the maximum extent permitted by law, in no event will QLM be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business interruption, arising out of or related to your use of (or inability to use) the website, even if advised of the possibility of such damages. To the extent any liability cannot be lawfully excluded, QLM’s liability is limited to direct damages actually incurred that are proximately caused by QLM’s material breach of these Terms.
Nothing in this section limits liability for gross negligence, willful misconduct, fraud, personal injury, or where such limitations are prohibited by California law (including Cal. Civ. Code §1668). This section applies only to website use (not to any services you hire us to perform, which are governed by a separate written agreement) and survives termination of these Terms. If you are dissatisfied with the website, your sole and exclusive remedy is to stop using the website.
16) Indemnification
You agree to indemnify and hold harmless QLM and our owners, employees, and contractors from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your misuse of the site; (b) your violation of these Terms; or (c) your infringement or violation of another person’s rights. This section does not require indemnification for QLM’s own gross negligence, willful misconduct, or fraud.
17) Governing law and venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Exclusive venue for disputes relating to the website will be in the state or federal courts located in Fresno County, California.
18) Termination
We may suspend or terminate access to the site at any time, with or without notice, for any reason, including if we suspect a violation of these Terms. Upon termination, Sections 8–17 and 19–21 will survive.
19) Force majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including acts of God, weather, labor disputes, epidemics, supply-chain issues, or government actions.
20) Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, or asset sale.
21) Miscellaneous
Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
No waiver. Failure to enforce a provision is not a waiver.
Entire agreement. These Terms and our Privacy Policy are the entire agreement regarding website use and supersede prior or contemporaneous communications on that subject.
Headings. Headings are for convenience and do not affect interpretation.
Notices. You agree we may provide notices by posting to the site or emailing the address you provide.
